Filing of motion and notice of hearing

Preliminary hearing dockets are scheduled for most Thursdays at 1:30. Before filing a motion for relief from stay, counsel for movant shall obtain a preliminary hearing date from this court's self-calendaring procedures online or the courtroom deputy's automated phone line at (214) 753-2046. In addition to filing the motion for relief from stay, counsel must separately file a notice of hearing. Failure to file a separate notice of hearing will result in the motion not appearing on the court's calendar.

The Court's Calendar

A list of lift stay motion settings will be available on the court's website on the Wednesday of the week prior to the preliminary hearing docket. Counsel for movant wishing to confirm that their motion is scheduled should review the court's calendar online. By 5:30 p.m. on the day before the preliminary hearing docket, a revised calendar will be posted to the website. The revised calendar will include all announcements of removal received by the courtroom deputy thus far.

Removing matters from the docket

(The Courtroom Deputy must be notified via e-mail or fax by 4:00 p.m. the day before the lift stay docket).

Upon request of counsel for movant, the courtroom deputy may:

  • Strike a motion from the lift stay docket if parties have reached an agreement.
  • Strike a motion from the lift stay docket if parties agree that the motion is unopposed.
  • Strike a motion that will be withdrawn by movant.
  • Reset a preliminary or final hearing to another lift stay docket (if parties agree to the reset).

Counsel for movant may request removal of a lift stay motion from the court's docket by either of the following communications:

  • Submit an agreed or unopposed order in CM/ECF. (Counsel wishing to confirm receipt of the uploaded order shall review the revised calendar on the court's website after 5:30p.m. on the day before the lift stay docket.)
  • Submit an agreed or unopposed order in word processing format on diskette in the Clerk's Office at 1100 Commerce Street, Room 1254, Dallas, TX 75242 or by mail. (Counsel wishing to confirm receipt of the submitted order shall review the revised calendar on the court's website after 5:30p.m. on the day before the lift stay docket.)
  • Email a request for removal to the courtroom deputy at sgj_settings@txnb.uscourts.gov (The courtroom deputy will confirm receipt of the email by replying to sender.)
  • Fax a request for removal to the courtroom deputy at (214) 753-2072. (Counsel wishing to confirm receipt of the fax shall review the revised calendar on the court's website after 5:30p.m. on the day before the lift stay docket.)
  • If parties agree to reset or pass a lift stay motion to another lift stay docket, counsel for movant shall select a reset date from this court's self-calendaring procedures and advise the courtroom deputy by email sgj_settings@txnb.uscourts.gov or by fax (214) 753-2072.
  • If the movant decides to withdraw the motion, a withdrawal of motion must be filed or an order withdrawing the motion must be submitted. Courtesy notification to the courtroom deputy by email sgj_settings@txnb.uscourts.gov or by fax (214) 753-2072 is appreciated.

Please note that requests for removals and/or resets are not accepted by phone.

Counsel with multiple motions on the same lift stay docket are encouraged to submit one email or fax listing all motions that may be removed by 4:00 p.m. on the day before the docket.
