The Judicial Conference adopted a policy to include official transcripts of court proceedings in electronic case files. After the filing of a transcript with the court, it may be viewed (but not printed) in CM/ECF at a public terminal at the court. Any other access to the document by non-court users is prevented for 90 days. However, as of implementation of CM/ECF 3.2, a user may pay the transcript fee to the court reporter/transcriber to gain access to the document via PACER (with PACER charges applying). The court reporter/transcriber will grant permission to such a user via the “Document Access Panel” (described below). PACER charges apply to the full transcript.
Within 21 days of a transcript being filed, parties must file with the court a Statement of transcript redaction, form BTXN202, listing the items to be redacted, citing the transcript’s docket number, the item’s location by page and line, and including only the following portions of the protected information:
the last four digits of the social security number or taxpayer identification number;
the year of the individual’s birth;
the minor’s initials; and
the last four digits of the financial account number.
The Statement of transcript redaction event is a private event. The PDF will only be available to court users. The attorney must notify the court reporter/ transcriber, who must then file a redacted transcript within 31 days of the date the original transcript was filed. The redacted version will become available after the 90-day restriction period, and the original unredacted version will remain restricted except to those who have purchased it or are using a public terminal.
Any additional redaction requires a separate motion for protective order and proposed order, also required within 21 days of a transcript being filed, and Court approval. A motion for protective order is a publicly filed document. If it contains information that should be sealed, the filer must file a motion to seal. See Sealed Documents.
Under Judicial Conference Policy, effective May 15, 2008, parties will be responsible for redacting from transcripts filed with the Court, information protected by the E-Government Act of 2002, Fed. R. Civ. P. 5.2(a). The court may remove restrictions on the transcript document (from the redacted version, if one exists, or the original transcript) via the Document Access Panel after the 90-day period.
As of implementation of CM/ECF 3.2, the court reporter/transcriber will give permission to an attorney has paid for a transcript, to access the transcript in PACER.
A party may review the transcript at the Clerk’s Office public terminals or purchase it by following the instructions on our website at http://www.txnb.uscourts.gov/Clerks-Office/transcript-and-Tape-Orders or by calling 214-753-2000. A party is only responsible for reviewing the:
opening and closing statements made on the party’s behalf; statements of the party;
testimony of any witness called by the party; and
any other portion of the transcript as ordered by the court.
NOTE: Redaction is the attorney’s responsibility. The Clerk, court reporter, or transcriber will not review this transcript for compliance.
To docket a transcript, the court reporter/transcriber must use Utilities in CM/ECF.
Document Access Panel in CM/ECF 3.2
A padlock icon will display next to the document link for a transcript on the Docket Report. The type of padlock icon and restrictions are:
A closed red lock: restricted access to the only or all documents
A closed yellow lock: multiple documents, some restricted and some not
An open green lock: no restrictions on documents
If there are multiple documents, clicking the padlock icon (or the document link, in the Docket Report or the History/Documents query) displays the Document Selection Menu, where each document has its own padlock icon.

Review the documents to ensure they meet the filing requirements
Docket the transcript [Utilities>File a Transcript] as follows:
Click Utilities
Click File a Transcript
Enter Case Number
Click Next
Select Transcript or Transcript (REDACTED) at the drop down menu
Click Next
Attach PDF of the transcript
Take steps based on the following scenarios
SCENARIO 1
If the entire transcript consists of only one document:
Click Next
Click Next again
SCENARIO 2
If more than one document makes up the complete transcript:
Select [yes] for Attachments to Document
Click Next
Attach the PDF for the first attachment of the transcript
Select Description and type in the page numbers for each attachment, i.e. “pages 41-80”
Select Add to List
Attach a PDF for each attachment of the transcript, following the above steps
Click Next
Click Next again
After the last action of either scenario is performed, then proceed as follows:
Select the appropriate hearing
Click Next
Enter:
Hearing date
Matter being heard
Court Reporter/Transcriber
Phone number for Court Reporter/Transcriber
Click Next
Click Next to accept 90 day default date
Select the Transcript Request Due deadline that corresponds to the hearing held date for the transcript
Click Next
Review final docket text for accuracy before submitting
Click Next
Review Notice of Electronic Filing
Review the documents to ensure they meet the filing requirements
Docket the Transcript [Utilities>File a Transcript] as follows:
Click Utilities
Click File a Transcript
Enter Case Number
Click Next
Select Transcript (REDACTED) from the drop down box
Click Next
Take steps based on the following scenarios
SCENARIO 1

Attach PDF

To give access to a transcript to an attorney or party who paid for the transcript, the court reporter/transcriber will go to the Utilities menu and select Review/Remove Transcript Access Restriction to search for the case in which the restricted transcript was filed and:
Enter the search date range (based on the schedule transcript release date)
Scroll through the list to locate the specific case
Click the red (or yellow) padlock in front of the document number for the restricted transcript
Click the name of the attorney or party from the "Available to grant access" box
NOTE: If not listed, type the name (last, first or first last), the first letters of the last name, or an attorney’s Bar ID and ENTER. Do not click on Submit when searching for an attorney or party.
Click Submit
The transcript remains restricted to everyone except those listed in the "Granted access" box
To remove a user from the “Granted access” list, the court reporter/transcriber will go to the Utilities menu and select Review/Remove Transcript Access Restriction to search for the case in which the restricted transcript was filed and:
Enter the search date range (based on the transcript release date)
Scroll through the list to locate the specific case
Click the red (or yellow) padlock in front of the document number for the restricted transcript
Click the name of the attorney or party to be removed in the "Granted access" box
Click Submit
Find the transcript entry on the docket sheet
Click on the document number in front of the transcript entry
The transcript displays in PDF if you paid the court reporter/transcriber
NOTE: The court reporter/transcriber will grant access to those who have paid for a transcript during the initial 90 day period following filing of the transcript.
NOTE: PACER charges apply to the full transcript.
