Bankruptcy Filings Rebound in Calendar Year 2007

"Bankruptcy filings in the federal courts rose 38 percent in calendar year 2007, according to data released today by the Administrative Office of the U.S. Courts. The number of bankruptcies filed in the twelve-month period ending December 31, 2007, totaled 850,912, up from 617,660 bankruptcies filed in calendar year 2006." Link to article

A NEW form order is now available on the court's website Forms section (Order Reopening for Limited Purpose of Enforcing the Order of Discharge) for debtors who want to reopen their cases to file adversary proceedings to enforce the discharge

If the debtor wishes to file a motion to reopen a bankruptcy case for the limited purpose of enforcing the order of discharge, this form order must be uploaded. All other orders will be rejected.

Bankruptcy Statistics for Calendar Year 2006

According to statistics released April 16th, 2007 by the Administrative Office of the U.S. Courts, bankruptcy filings fell 70 percent in Calendar Year 2006. However, bankruptcies filed for the last three months of calendar year 2006 were the highest of any quarter in the calendar year. The statistics cover the first full 12-month period in which the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA) has been in effect. Although the security code field has been on the data entry screen and its use has been optional, it will become a required field, as an additional protection to reduce fraud for credit-card holders. Consisting of three or four digits, credit card security codes usually are printed on the back of a credit card and are used to verify that the purchaser actually posses the credit card when making an Internet purchase or purchase via telephone.

On Monday, October 25, 2004, the President signed into law S. 2864. This law retroactively extends Chapter 12 of the Bankruptcy Code for 18 months from January 1, 2004 until July 1, 2005. Automatic Adjustment of Certain Dollar Amounts in the Bankruptcy Code and Official Bankruptcy Forms
On April 1, 2004, automatic adjustments to the dollar amounts stated in various provisions of the Bankruptcy Code, Title 11, U.S.C., will become effective. These amended dollar amounts will apply to cases filed on or after April 1, 2004. Two of the Official Bankruptcy Forms Contain references to several of the affected dollar amounts. Official Form 6E, Schedule of Creditors Holding Claims Entitled to Priority, and Official Form 10, Proof of Claim, will be amended April 1, 2004, and will apply to cases filed on or after that date.

CHAPTER 12 EXTENDED UNTIL JANUARY 1, 2004

On August 15, 2003, the President signed into law H.R. 2465 (Public Law l08-73), which retroactively extends chapter 12 of the Bankruptcy Code for six months from its previous expiration date of July 1, 2003. As a result, Chapter 12 has been extended until January 1, 2004.

New chapter 12 cases can be accepted for filing, and cases that were filed under other chapters in the period from July 1, 2003, through August 15 can be converted to chapter 12. The statutory filing fee for a chapter 12 case remains at $200.

Cases previously assigned to Judge Harold Abramson were reassigned on 8/22/2003 to Judge Steven Felsenthal, Judge Barbara Houser, and Judge Harlin Hale according to existing judge assignment percentages. The court will assign many of the proceedings pending before Judge Abramson, and under advisement with Judge Abramson, as deemed necessary by the judges. Judge Abramson will hear, by assignment, all pending proceedings on his calendar for the month of September 2003, along with all the matters under advisement with Judge Abramson. Judge Abramson will hear the Chapter 13 docket set in his court for the month of October 2003.

REMINDER

On Tuesday, May 13, 2003, the court modified the format required for all orders submitted electronically. The court's order processing system will affix the judge's signature at the top of electronically submitted orders. Therefore, all orders submitted electronically must contain a top margin on the FIRST PAGE of four (4) inches. All other pages of the order will have a top margin of one (1) inch. The LAST LINE in the order must be "# # # End of Order # # #" centered in the middle of the page to indicate the order is completed. Any signatures and/or attachments will be placed below this line. A line for the date and a signature line for judge is to be omitted. An example order can be found in the ECF section of our website.

All PAPER orders submitted to the court should be formatted in the traditional manner with a space provided on the last page for the judge's signature.

Orders regarding motions that will be considered by the court on or after May 13, including orders regarding motions with objection deadlines that will expire on or after May 13, 2003, and orders regarding motions that will be heard by the court on or after May 13, 2003, should be submitted in the new format.

A complete creditor mailing list is required to be filed with the petition, Fed. R. Bankr. P. 1007. Noticing of Orders and Judgments Entered By the Court

Attorneys should no longer submit self-addressed stamped envelopes for the return of orders or judgments. On February 17, 2003, the Clerk's office began noticing all orders and judgments entered by the court through the Bankruptcy Noticing Center (BNC). Immediately upon the entry of an order or judgment, the Clerk's office transmits a complete copy of the document to the BNC. The BNC will mail a copy of the order or judgment to relevant parties in a case.

The Clerk's office and chambers staff will no longer return copies of signed orders to parties submitting self-addressed stamped envelopes. Orders entered by the court are available for viewing, downloading, and printing via Pacer.

Reduction in Number of Copies of Documents Required to Initiate a Bankruptcy Case

Effective February 17, 2003, the Court will reduce the number of copies of petitions, schedules, statements and plans required to initiate a bankruptcy case. The copies that will be eliminated are currently used to provide a copy to the chapter 7, 12, 13 case trustees. The cost of producing, sorting, and distributing these extra copies is significant. As of February 17, 2003, the specified documents will be provided to the case trustees in electronic form.

Previously, an original and two (2) copies are required to initiate chapter 7, 12, and 13 cases; however, on and after February 17, 2003, an original and one (1) copy will be required to initiate a chapter 7, 12, or 13 case (the one copy will be stamped and returned to the filing party as proof of the filing). This reduction will also conform to the existing requirements for initiating a chapter 11 case.

SUBJECT:   Requests for Hearings now Accepted by E-mail

Effective Thursday, June 1, 2000, the Dallas Division of the United States Bankruptcy Court for the Northern District of Texas, will accept requests for hearings by electronic mail (e-mail). This service is being offered in addition to the telephonic method currently in practice. All requests for hearing on motions, applications and/or adversary complaints must be made prior to the filing of the pleading with the Court. Requests for a hearing date and time may be made by telephone or e-mail by contacting the appropriate Courtroom Deputy.

When requesting a hearing, please provide the following information:

  1. Case name

  2. Case number

  3. Adv. number (if applicable)

  4. Style of Motion

  5. Amount of court time requested

  6. Any special noticing requirements

  7. Your name and phone number

The Clerk’s Office will only acknowledge receipt of the request by responding with the hearing date, time and location. To receive confirmation that your electronic request was received by the Court, please use the "Return Receipt" option when sending your e-mail.

As with telephonic requests, requesting a hearing via e-mail will only reserve the time on the Court’s calendar. The setting is not confirmed until the document is filed with the assigned hearing date and time noted on the pleading in accordance with Local Bankruptcy Rule 5005.1. If the document is not filed within 48 hours of the confirmed hearing request, the reserved date and time will be released from the Court’s docket.

For additional information or questions regarding this procedure, please contact the appropriate Courtroom Deputy. We hope that this procedure will improve our efficiency in handling your requests for settings.

DATE:   May 12, 2000

SUBJECT:   Change in Discharge Hearing/Reaffirmation Procedure - for Abilene, Amarillo, Lubbock and San Angelo Divisions 

Effective June 8, 2000 Discharge/Reaffirmation Hearings will no longer be held for Abilene, Amarillo, Lubbock and San Angelo division cases. (The only reaffirmation agreement which will require a hearing will be one filed in a pro se case.) The discharge will automatically be entered 30 days after the last date to file objections to discharge and/or dischargeability. Reaffirmation agreements, in general, should be filed prior to the expiration of that deadline. The automated discharge program will check for specific events and will NOT enter a discharge if any of the following have occurred:

  • 727 adversary complaint has been filed
  • Motion to dismiss is pending
  • Motion to extend the time to object to the discharge has been filed
  • Motion to extend the time to file a Motion to Dismiss has been filed
  • Order denying discharge has been entered
  • Motion to convert is pending or has been granted
  • First meeting continued or not held
  • Motion to defer entry of discharge filed
  • Final installment fee due

DATE:  December 6, 1999

SUBJECT:  Filing Motions to Reinstate Case

An Order to Close Case is administrative in nature and therefore is not a required document needed to close a case which has been dismissed. Effective immediately, the Clerk's Office will no longer charge a reopening fee to file a Motion to Reinstate a dismissed case, even if a closing order has been entered in the case. Notice is hereby given that a photocopy of the Order of Dismissal shall be attached to a Motion to Reinstate Case presented for filing. This change in procedure will assist the Clerk's Office in efficiently processing these motions.

NOTICE

DATE:  October 15, 1999

SUBJECT:  Attorneys Not Admitted To Practice In The Northern District Of Texas

Effective September 1, 1999, attorneys licensed to practice law by the highest court of any state or the District of Columbia, but not admitted to practice in the Northern District of Texas must comply with the following procedures in any case in the district in which they desire to file pleadings or to appear as counsel.

1. Complete the court approved Application and Order for Admission Pro Hac Vice form. This form is available in the Bankruptcy Clerk's Office or online

2. Submit the original and two copies of the completed form to the U.S. District Cler'’s Office in the division where the case is pending along with a $25.00 check payable to "Clerk, U.S. District Court." In the Dallas Division, you may also pay by Visa or MasterCard.

3. Present the original and one copy of the application along with the receipt for payment of the $25.00 fee to the U.S. Bankruptcy Clerk's Office for filing. The application will be reviewed by the presiding bankruptcy judge. If granted, the applicant may proceed pro hac vice in the case identified in their application. If denied, the $25.00 fee will be returned to the applicant.

SUBJECT: STANDING ORDER CONCERNING ALL CHAPTER 13 CASES AND NOTICING FEES IN CHAPTER 12 AND 13 CASES

On August 17, 1998, the judges of the U.S. Bankruptcy Court for the Northern District of Texas adopted General Order 98-4. General Order 98-4 is a standing order concerning all chapter 13 cases and noticing fees in chapter 12 and 13 cases. General Order 98-4 supersedes General Order 93-1.
