Clerk's Notice 16-05 (Regarding Pending Bankruptcy Rule, Form, and Fee Changes Effective Thursday, December 1, 2016)

The Supreme Court adopted changes to the Federal Rules of Bankruptcy Procedure and the Official Bankruptcy Forms, which are scheduled to take effect on December 1, 2016.

  • Bankruptcy Rules 1010, 1011, 2002, 3002.1, 7008, 7012, 7016, 9006, 9027, and 9033 have been amended, and Rule 1012, which govern responses to petitions for recognition in cross-border cases, has been added;
  • Official Bankruptcy Forms 420A and 420B have been amended to conform to the numbering scheme of the Forms Modernization Project along with changing the phrase “mail” to “send” to reflect the fact that there are various methods of providing documents to other parties; and Form 410S2, Notice of Postpetition Mortgage Fees, Expenses, and Charges, is amended in the instructions in Part 1 to clarify how to report previously approved fees, expenses, or charges.
